Oster's lawyer gets evidence from state E-mail
Thursday, 06 December 2007

By VINAYA SAKSENA

LINCOLN -- The attorney representing ex-Town Administrator Jonathan Oster has received the paperwork he asked the state to provide in advance of Oster’s long-delayed bribery trial.

But he’s not sure he’s got all of what he asked for.

Under discovery rules, C. Leonard O’Brien has been trying to nail down specifics of the state’s case against his client. At the end of last month, Associate Justice Gilbert V. Indeglia questioned why O’Brien and Assistant District Attorney William Ferland had not been able to reach an agreement on the matter.

At that time, Ferland, after some hesitation, said he could have the materials in O’Brien’s hands by Dec. 5, a date that seemed agreeable to O’Brien.

Oster’s attorney said Wednesday that he had received “the stuff they were supposed” to provide him. The question, he said, was whether all of what he wanted was there.

“We’ve received material from the prosecution,” O’Brien said, “and we’re in the middle of reviewing that.”

He declined to comment further.

The case is slated to be back in court Dec. 13, when the judge is expecting to address several outstanding motions. Oster’s trial is currently scheduled to start with a “date certain” of Jan. 9, 2008.
