City, contractor agree to dismissal of lawsuit over work at library

CENTRAL FALLS — Both sides have agreed to dismiss a Superior Court lawsuit that had been filed by Certified Disaster Restoration Corp., owned by convicted contractor Michael Bouthillette, over $30,000 that Bouthillette had been trying to collect from the city for work done in late 2006 and early 2007 at the Adams Memorial Library.

On March 3, both Central Falls City Solicitor Matthew T. Jerzyk and the attorney for Certified Disaster Restoration Corp., Joseph J. Reale Jr., signed an agreement stipulating that the plaintiff's claims be “dismissed with prejudice, no interest or costs.” The stipulation was filed in Superior Court.

Reale, a Providence attorney, was reportedly out of town and could not be reached for comment on the matter. An arbitrator had been assigned to the case, but the arbitration had been canceled and both parties reached an agreement on their own, Jerzyk said.
